1. Purpose
The purpose of this agreement is to establish the terms and conditions for the use of ‘Pharmaco-Net Tokens’ provided through the web platform (hereinafter referred to as the ‘Pharmaco-Net’) of Calici Co., Ltd. (hereinafter referred to as the ‘Company’) for various services provided through Pharmaco-Net.
2. Explanation and Amendment of Terms
The content of this agreement becomes effective by being announced on the website and service screens.The ‘Company’ may amend the content of this agreement if reasonable grounds for change arise.The Company may modify this agreement when deemed necessary.If the agreement is changed, the Company will announce the revised content and effective date of the changed agreement online on the website at least 7 days prior to its enforcement. However, in the case of changes that are disadvantageous to members, the Company will provide notice at least 30 days in advance and clearly indicate the contents before and after the revision to facilitate members’ understanding.
3. Definition of Terms
Pharmaco-Net Token:
Pharmaco-Net Token is a virtual currency used as an online payment method for purchasing paid services through the Pharmaco-Net platform. It is converted at a rate of 5 tokens per 1 dollar and can be charged, paid, and refunded using the Pharmaco-Net ID as a reference.
Charge: Charging refers to purchasing “Pharmaco-Net Tokens” in fixed monetary units through the payment methods provided by Pharmaco-Net.Paid Services:Paid services refer to the services that users can access by making payment using the payment methods provided by Pharmaco-Net.Coupon:A coupon is a means through which Pharmaco-Net provides a certain amount of “Pharmaco-Net Tokens” free of charge.
4. Charging Pharmaco-Net Tokens
- Charging Pharmaco-Net Tokens is possible through payment methods provided by Pharmaco-Net, such as credit/debit cards. However, in cases where separate operators are responsible for each payment method, members must follow the procedures prescribed by the respective payment method operator before using that payment method. Payment of Pharmaco-Net’s service usage fees through a particular payment method will be considered as complying with the procedures and terms of use set by the operator of that payment method.
- Charging Pharmaco-Net Tokens is available in units determined by the Company’s internal policy. The Company may also impose monthly charging limits based on its policy. In this case, separate payment limits may be established for each payment method in accordance with the policies of the payment method operator or government regulations.
5. Approval of Pharmaco-Net Tokens
- Pharmaco-Net may reject or later cancel the approval of the following types of applications:
- Applications made using someone else’s name or identity theft.Applications with missing or incorrect mandatory information, or incomplete essential procedures.Cases where payment instrument holders have not consented or authorized the unauthorized use of the payment instrument to pay usage fees.Other cases where approval is deemed impossible due to the member’s fault.
- Pharmaco-Net may restrict the approval of applications under the following circumstances until the reasons for approval restrictions are resolved:
- When there is an insufficient service facility to provide satisfactory service.When there is a service failure.
6. Usage of Pharmaco-Net Tokens
- Pharmaco-Net Tokens are used to access paid services provided by Pharmaco-Net. Members can view their payment and usage history on the website.
- In the event of significant defects in Pharmaco-Net services that result in data damage, corruption, deletion, or malfunction, members may be compensated through recharging Pharmaco-Net Tokens or restoring the affected data.
- There is no interest income generated from the balance of Pharmaco-Net Tokens.
7. Expiration of Pharmaco-Net Tokens
Pharmaco-Net Tokens will expire automatically if there is no usage history for a period of 12 months from the final date of service utilization.
8. Withdrawal of Subscription
- Members who have entered into a contract with Pharmaco-Net for the purchase of Pharmaco-Net Tokens can withdraw their subscription within 7 days from the date of charging.
- Notwithstanding the provisions of the preceding paragraph, if the content of the Pharmaco-Net Tokens differs from the contents of advertisements or the contract’s terms are not fulfilled, members can withdraw their subscription within 3 months from the date of Pharmaco-Net Token charging or within 30 days from the day they become aware of the fact.
- Members can apply for withdrawal of subscription through Pharmaco-Net’s 1:1 customer center. When a member applies for withdrawal, the company will promptly collect or delete the Pharmaco-Net Tokens and refund the received payment within 3 business days from the date of collection or deletion.
- When withdrawing the subscription, the charged amount will be refunded to the payment method used.
- Other matters related to withdrawal of subscription are subject to Article 14 of the Pharmaco-Net Terms of Use.
9. Refund of Pharmaco-Net Tokens
- Even in cases where withdrawal of subscription is not possible under Article 7, if Pharmaco-Net Tokens that have not been expired remain, members can request a refund for the remaining balance of Pharmaco-Net Tokens charged through their account. If members request a refund for the remaining balance of Pharmaco-Net Tokens charged through their account, they can receive a refund through the proper procedure. However, Pharmaco-Net Tokens received for free cannot be refunded.
- The refund amount will be reimbursed to the same payment method used at the time of payment.
- After 7 days from the date of purchase or after the period specified in Article 8(2) has passed, when requesting a refund, a refund fee of 3% of the remaining Pharmaco-Net Token balance will be deducted, and if the Pharmaco-Net Token balance is less than 1,000 won, a refund will not be possible. However, in cases where the company is at fault, the refund fee will not be deducted.
- If a member is engaged in fraudulent activities within Pharmaco-Net, repeated exploitation of bugs, or other activities that have a serious negative impact on the service operation, Pharmaco-Net may restrict the use of the account or terminate the contract with the member without refunding the usage fee. However, if a member provides evidence that they have not engaged in serious illegal activities or activities with a serious negative impact on service operation, this does not apply.
10. Protection of Personal Information
- Pharmaco-Net shall only use members’ information related to the Pharmaco-Net Token service for the purpose of providing services under this usage agreement and shall not disclose or distribute such information to third parties without prior consent. However, this does not apply in the following cases:
- When providing in a form that does not identify specific individuals for statistical purposes, academic research, or market researchIn cases where there are specific legal provisions.
- Other matters related to personal information protection are subject to Pharmaco-Net’s “Privacy Policy”.
Obligations of Pharmaco-Net
- In cases where an overpayment is made due to Pharmaco-Net’s intentional act or fault, Pharmaco-Net shall refund the entire overpayment. In this case, the refund will be made through the same payment method used by the member for the payment. If it is not possible to refund through the same method, Pharmaco-Net will refund the entire amount after verifying the identity of the payer. However, in cases where the overpayment is due to the member’s intentional act or fault, the cost incurred for refunding the overpayment shall be borne by the user within a reasonable range.
- Pharmaco-Net must perform the services properly within the scope not falling under the exemption clause of Article 12.
12. Restriction of Service Use
In cases where the following actions are taken, Pharmaco-Net may restrict the use of all or part of the service or delete (repossess) related accounts, and when goods are abnormally obtained, the Pharmaco-Net Tokens related to the account may be repossessed:
- Actions that cause system overload, hacking, or other undue burdens on the system.
- Transferring or trading the rights to Pharmaco-Net services to third parties.
- Manipulating, altering, or fraudulently obtaining or using/distributing payment methods for Pharmaco-Net Token purchases.
Suspension of Service Provision
- Pharmaco-Net may suspend service provision under the following circumstances:
- In cases of unavoidable maintenance work, such as maintenance of service equipment.When the telecommunications service provider specified under the Telecommunications Business Act suspends telecommunications services.In cases of other force majeure circumstances.
- In situations such as national emergencies, power outages, equipment failures, or overwhelming use of services that hinder normal service usage, Pharmaco-Net may restrict or suspend the entire or partial service.
14. Exemption Clause
- In cases where Pharmaco-Net cannot provide the service due to force majeure or events equivalent to force majeure, Pharmaco-Net is exempt from the responsibility of providing the service.
- Pharmaco-Net is not responsible for service disruptions caused by the member’s fault.
- As the services provided by Pharmaco-Net can result in various outcomes based on the individual actions of members, Pharmaco-Net is not responsible for problems arising from the member’s choices and actions.
- Pharmaco-Net is not responsible for the reliability, accuracy, or content of information, data, facts, etc. posted by members, unless Pharmaco-Net has intentional misconduct or gross negligence.
- Pharmaco-Net may restrict service usage hours for services or members according to relevant laws, government policies, and other factors. Pharmaco-Net is not responsible for matters related to such restrictions or the consequences arising from them.
